Monopoly creates centralization and competition ensures protection of interest of consumers. In India, law relating to Competition is governed by Competition Act, 2002, replacing the Monopolies Restrictive and Trade Practice, 1969, the key object of which is to "prevent practices having adverse effect on competition, to promote and sustain competition in the markets, to protect the interest of the consumers and to ensure freedom of trade."
Under the act, Competition Commission of India (CCI) is constituted whose prime role is to: -
- Enquiry into anti-competitive agreement
- Abuse of dominant position
- Regulating mergers and acquisitions
- Advocacy of competition & creating pubic awareness
- Prevention of statutory restrain over competition
- Recommendations and giving advice to authorities
- Deciding issues arising under the Act, and referring to Director General for conducting investigation
