Constitution is the Supreme Lex in India. All authorities i.e. legislative, executive, judiciary derive their powers from the constitution. It is fundamental principle that all authorities functions within their constitutional limits. Actions which transgress the constitutional limits are rendered unconstitutional. Supreme Court and High Court are also known as constitutional courts, upon whom the responsibility rests to ensure that all authorities function within constitutional limits. Constitutional courts in exercise of its power under article 32 and 226 of the Constitution have power to strike down any action of executives or legislative bodies if they are found to be de hors the constitution.
